Terms of Service

1. Scope of Services

The Lav Forge operates as a boutique software development agency specializing in custom Lua programming for the World of Warcraft client. Services include but are not limited to: custom addon development, WeakAura suite creation, UI configuration and optimization, private server addon adaptation, and post-delivery support. All services are provided on a per-project basis unless an ongoing retainer agreement is established in writing.

2. Technical Limitations

All development is strictly constrained by the limitations of the official World of Warcraft public API and user interface engine. We cannot and will not develop addons that: (a) Automate gameplay inputs (botting, auto-casting, rotation automation); (b) Access or modify game memory directly; (c) Circumvent anti-cheat systems; (d) Provide unfair competitive advantages in PvP contexts that violate Blizzard's Terms of Service. Any request for such functionality will be refused and reported if deemed malicious.

3. Client Responsibilities

You agree to provide accurate and complete project specifications. You are responsible for testing delivered code in a timely manner and providing feedback. You must ensure that your account and payment information are current and valid. You agree not to use delivered addons for purposes that violate Blizzard Entertainment's Terms of Service or local laws. You acknowledge that custom addons may conflict with other third-party addons and assume responsibility for compatibility testing.

4. Payment Terms

Payment terms are established on a per-project basis. For projects under $500 USD, full payment is typically required upfront. For larger projects, a 50% deposit is required to begin work, with the remaining 50% due upon delivery. Payment is processed through third-party platforms (Fiverr, PayPal, etc.) and subject to their terms and refund policies. Failure to pay the final balance may result in delayed or withheld delivery of source code.

5. Intellectual Property

Upon full payment, you own the custom code developed for your project, including all Lua scripts, XML layouts, and associated assets. The Lav Forge retains the right to use generic code libraries, utility functions, and architectural patterns in future projects for other clients. We do not claim ownership of your gameplay strategies, guild-specific logic, or unique business logic incorporated into your addon. Third-party libraries (e.g., Ace3, LibStub) remain under their respective licenses.

6. Delivery and Acceptance

Delivery is considered complete when: (a) All agreed-upon features are implemented according to specifications; (b) The code is provided in a usable format (Lua files, packaged addon folder, or WeakAura strings); (c) Basic installation instructions are provided. You have 7 days from delivery to test the addon and request bug fixes at no additional cost. After 7 days, or if you approve the delivery, the project is considered accepted. Minor adjustments may be negotiated but are not guaranteed without additional compensation.

7. Support and Maintenance

All projects include 1 month of free post-delivery support for bug fixes and compatibility issues caused by game patches. This support does not cover: (a) New feature requests; (b) Conflicts caused by installing other third-party addons; (c) Issues resulting from manual modification of the code by the client. After the support period, ongoing maintenance can be purchased as a separate service or via retainer agreement. Blizzard game patches may break addons; we will fix patch-related issues during the support period at no cost.

8. Refund Policy

Refunds are handled on a case-by-case basis. If we cannot deliver the agreed-upon features due to technical limitations, a full or partial refund will be issued. If you cancel a project after work has begun, you will be refunded the balance minus compensation for work already completed. No refunds will be issued for completed and delivered projects. Disputes over code quality or feature implementation will be resolved through good-faith negotiation and, if necessary, third-party arbitration.

9. Limitation of Liability

The Lav Forge is not liable for: (a) Game account suspensions or bans resulting from addon usage (though we ensure all code complies with Blizzard's ToS); (b) Lost in-game gold, items, or progress due to addon malfunction; (c) Data loss or corruption; (d) Indirect, incidental, or consequential damages. Our total liability is limited to the amount paid for the specific service in question. Use of custom addons is at your own risk.

10. Confidentiality

We maintain strict confidentiality regarding your project details, gameplay strategies, and any sensitive information shared during development. We will not disclose your custom addon code to other clients or publish it publicly without your explicit written consent. This confidentiality obligation survives the termination of our business relationship.

11. Termination

Either party may terminate the agreement with written notice. If you terminate, you will be charged for work completed up to the termination date. If we terminate due to your breach of these terms (e.g., non-payment, harassment, illegal requests), we reserve the right to withhold delivery and pursue payment for completed work. We reserve the right to refuse service to anyone at our discretion.

12. Governing Law

These Terms of Service are governed by and construed in accordance with applicable laws. Any disputes arising from these terms or our services will be resolved through binding arbitration in accordance with the rules of the relevant arbitration association. The prevailing party in any dispute is entitled to reasonable legal fees and costs.

13. Modifications to Terms

We may modify these Terms of Service at any time. Material changes will be communicated via Discord or email at least 30 days before taking effect. Continued use of our services after such notice constitutes acceptance of the modified terms. It is your responsibility to review these terms periodically.

14. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

15. Entire Agreement

These Terms of Service, along with any project-specific agreements or quotes, constitute the entire agreement between you and The Lav Forge. These terms supersede all prior discussions, agreements, or understandings, whether written or oral. Waiver of any provision in one instance does not constitute waiver of that provision in future instances.
